We operate a registered food business, subject to supervision by ASAE — Autoridade de Segurança Alimentar e Económica.

Hereinafter "All Together Greens", "we" or "us".

2. Scope and acceptance

These Terms govern the use of alltogethergreens.com and every order placed through it for collection in store, whether of food or of merchandise. We do not deliver and we do not ship: every order placed on this site is collected at our store in Lisbon.

By placing an order you confirm that you have read, understood and accepted these Terms and our Privacy Policy. We recommend that you save or print a copy. The version applicable to your order is the one published on this site at the moment the order is placed.

3. Definitions

  • Consumer — a natural person acting for purposes outside their trade, business, craft or profession, as defined in Law No. 24/96.
  • Order — a request to purchase Food Products or Merchandise for collection in store.
  • Food Products — the freshly prepared food and beverages offered on our site.
  • Merchandise — non-perishable goods offered on our site, such as apparel, bottles, tote bags, packaged products and similar items.
  • Collection — handover of the order at the store selected at checkout.

Different rules apply to Food Products and to Merchandise. Where a section applies only to one category, this is stated expressly.

4. Eligibility

You must be at least 18 years old and have full legal capacity to contract.

We do not sell alcoholic beverages through this site.

5. Account

You may order as a guest or create an account. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate an account in cases of fraud, abuse or breach of these Terms.

6. Products, menu and food information

Our menu changes with seasonal availability. Photographs are illustrative; the appearance and exact weight of a freshly prepared item may vary.

In accordance with Article 14 of Regulation (EU) No 1169/2011 and Decree-Law No. 26/2016, mandatory food information — including the presence of any of the 14 regulated allergens — is made available on the product page before your purchase is concluded, and again at the moment of collection, at no additional cost. If any information is unavailable or unclear, please do not complete the order: contact us first.

All products are offered subject to availability. Where an ingredient is unavailable, section 8 of our Order, Collection & Refund Policy applies.

7. Merchandise

Merchandise sold on our site complies with applicable EU product safety legislation, including Regulation (EU) 2023/988 on general product safety. The name and contact details of the manufacturer or of the responsible person established in the European Union are shown on each product page, as required since 13 December 2024.

Where we sell textile items, fibre composition is labelled in accordance with Regulation (EU) No 1007/2011.

Merchandise sizes, colours and dimensions shown on the site are indicative; minor variations in colour reproduction between screens do not constitute a lack of conformity.

8. Prices and VAT

Prices are shown in euros (EUR) and include VAT at the applicable rate.

Food and beverage services and ready-to-eat meals for takeaway are generally taxed at the intermediate rate (13% on mainland Portugal), while alcoholic beverages, soft drinks, juices, nectars and carbonated waters are taxed at the standard rate (23%). Merchandise is generally taxed at the standard rate. Where a menu or promotion is sold at a single price, the amount is apportioned across the applicable rates on the invoice.

Because all orders are collected in store, no delivery or shipping charge is ever added: the price you see is the price you pay.

Prices may change at any time, but a change never affects an order already confirmed.

Obvious pricing errors. Where a price is manifestly incorrect due to a technical or human error, we are not obliged to supply at that price. We will contact you promptly, and you may either confirm the order at the corrected price or cancel it for a full refund.

9. How the contract is concluded

  • You select items and, for Food Products, customise them.
  • You review your basket and may modify quantities or remove items.
  • You choose the collection store and, for Food Products, the collection time.
  • You enter your details and choose a payment method.
  • You are shown a full order summary, including items, taxes and total, and you are able to identify and correct any input errors before confirming.
  • You accept these Terms and click Pay now, which creates an obligation to pay.
  • We send you an order confirmation by email. The contract is concluded at that moment, and we begin preparing your order.

The contract may be concluded in Portuguese or English. We file the order details, and you may access your order history in your account or request a copy from us.

10. Payment

Accepted payment methods: debit and credit cards (including Visa, Mastercard, Maestro and UnionPay), Multibanco, Klarna, Apple Pay and Google Pay, processed by Shopify Payments, operated by Shopify International Limited, over a secure connection. We never have access to your full card details.

Card payments may require strong customer authentication (3-D Secure) under Directive (EU) 2015/2366. Orders are prepared only once payment is confirmed. An invoice is issued for every order in accordance with Portuguese tax law.

11. Right of withdrawal — Food Products

In accordance with Article 17 of Decree-Law No. 24/2014, the 14-day right of free termination (right of withdrawal) does not apply to our Food Products. Two separate exemptions apply:

  • Article 17(1)(d) — the supply of goods liable to deteriorate or expire rapidly. Our food is freshly prepared and highly perishable.
  • Article 17(1)(l) — contracts for the supply of catering services where the contract provides for a specific date or period of performance. You select a specific collection time at checkout.

By confirming an order of Food Products you acknowledge that you lose the right of withdrawal in respect of those items. This is stated on the checkout page before payment.

This exclusion does not affect your cancellation rights under section 6 of our Order, Collection & Refund Policy, your right to a refund under section 9 of that policy, or your statutory rights where the food is not in conformity (section 13 below).

12. Right of withdrawal — Merchandise

As a consumer, you have the right to withdraw from the purchase of Merchandise within 14 calendar days, without giving any reason.

Withdrawal period. The period expires 14 days from the day on which you, or a third party indicated by you, acquires physical possession of the Merchandise. Where an order comprises several items handed over separately, the period runs from receipt of the last item.

How to exercise it. Inform us of your decision by an unequivocal statement, sent to ALL TOGETHER GREENS, LDA, Avenida dos Bombeiros Voluntários, 731, 2765-202 Estoril, Portugal, or by email to geral@alltogethergreens.com. You may use the model withdrawal form in the Annex to these Terms, but you are not obliged to. To meet the deadline it is sufficient that you send your communication before the period expires.

Returning the goods. You must return the Merchandise without undue delay and in any event within 14 days of notifying us. The deadline is met if you dispatch or hand over the goods before that period expires. You may return items in person at the store where you collected them.

Return costs. Returns made in person at our store are free of charge. Where you choose instead to send the goods back by post or courier, you bear the direct cost of that return.

Refund. We will reimburse all payments received from you in respect of the returned Merchandise without undue delay, and no later than 14 days from the day we are informed of your decision. We may withhold reimbursement until we have received the goods back, or until you supply evidence of having sent them, whichever is earliest. We will use the same means of payment you used for the original transaction, and you will incur no fees as a result.

Diminished value. You are liable only for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

Exceptions. In accordance with Article 17 of Decree-Law No. 24/2014, the right of withdrawal does not apply to Merchandise that is made to your specifications or clearly personalised, or to sealed goods that are not suitable for return for health protection or hygiene reasons and were unsealed after collection. Any such exception is marked clearly on the relevant product page.

13. Conformity of Food Products

Under Decree-Law No. 84/2021 and Law No. 24/96, food supplied must correspond to its description and be fit for consumption. Given the perishable nature of these products, the statutory guarantee is exercised immediately on collection, or on the same day.

Where an item is not in conformity — for example a wrong item, a missing item, an ingredient you had excluded, or food unfit for consumption — you are entitled to replacement or a full refund of that item, at your choice and at no cost. Where the non-conformity affects the order as a whole, you may terminate the contract and obtain a full refund.

The multi-year conformity periods set out in Decree-Law No. 84/2021 for durable goods do not apply to perishable food consumed within hours of purchase.

14. Legal guarantee of conformity — Merchandise

Merchandise is covered by the statutory guarantee of conformity under Decree-Law No. 84/2021:

  • We are liable for any lack of conformity that becomes apparent within 3 years of handover.
  • Any lack of conformity appearing within 2 years of handover is presumed to have existed at that moment, unless proved otherwise or unless the presumption is incompatible with the nature of the goods or of the defect.
  • Where a lack of conformity appears within the first 30 days, you may choose directly between replacement of the goods and termination of the contract.
  • Otherwise you are entitled, in the first instance, to repair or replacement, free of charge and within a reasonable time; and, where that is impossible, delayed or causes significant inconvenience, to a proportionate price reduction or termination of the contract with a refund.
  • Where you opt for repair, an additional guarantee period of six months applies to the repaired item, up to a maximum of four repairs.
  • You are not required to notify the defect within any fixed period from discovery, but you must exercise your rights within the guarantee period.

To make a claim, contact geral@alltogethergreens.com with your order number, a description of the problem and photographs where relevant.

Any commercial guarantee offered by us or by a manufacturer is additional to, and never replaces or limits, this statutory guarantee.

15. Food safety and hygiene

We operate a food safety management system based on HACCP principles, in accordance with Regulation (EC) No 852/2004, and we are subject to inspection by the competent authorities. Our staff receive food hygiene training.

Once an order has been collected, responsibility for correct storage and handling passes to you. See section 11 of our Order, Collection & Refund Policy.

16. Health and nutrition claims

Any nutritional or health claim on our site complies with Regulation (EC) No 1924/2006. Our products are food, not medicinal products, and are not intended to diagnose, treat, cure or prevent any disease.

Nutritional information provided is indicative and may vary with portion size and seasonal ingredients. If you have a medical condition or specific dietary needs, please consult a qualified health professional.

17. Complaints about an order

Wherever possible, tell us at the counter at collection — we will resolve the matter on the spot. Otherwise, contact geral@alltogethergreens.com on the same day with your order number, a description of the problem and photographs where relevant. We acknowledge complaints within 1 business day and aim to resolve them within 7 days.

18. Intellectual property

The "All Together Greens" name and logo, together with all text, photographs, video, graphics, recipes as expressed on the site, layout, software and databases, are owned by or licensed to All Together Greens, LDA and protected by Portuguese and international intellectual property law.

You may view, download and print content for your own personal, non-commercial use. Any other reproduction, distribution, public communication, modification, extraction or commercial exploitation requires our prior written consent.

19. Reviews and user content

If you submit reviews, comments or photographs, you grant us a non-exclusive, worldwide, royalty-free, transferable licence to use, reproduce, adapt and display that content in connection with our business. You warrant that the content is your own, accurate, and does not infringe third-party rights or applicable law. We may remove content that is unlawful, offensive, misleading or irrelevant.

Verification of reviews. We publish reviews only from customers who have placed an order through our store. We do not publish fake reviews and we do not commission anyone to submit reviews. This statement is made under the Unfair Commercial Practices Directive as amended by Directive (EU) 2019/2161.

20. Prohibited use

You agree not to use this site to breach any law, transmit malware, attempt unauthorised access to our systems, use automated scraping or data-harvesting tools without our consent, place fraudulent or speculative orders, or interfere with the site's operation or security.

21. Promotions, loyalty and gift cards

Promotional codes are valid only for the period and under the conditions stated in each promotion, cannot be exchanged for cash, and cannot be combined with other offers unless expressly stated. We may cancel orders where a code has been obtained or used fraudulently or in breach of its conditions.

Loyalty programme. Customers with an account take part in our points programme on the following terms:

  • You earn 10 points when you create an account, and 1 point for each euro spent on an order, once that order has been collected.
  • 100 points can be exchanged for a €10 discount, to be used on an order placed through this website.
  • Points have no cash value, cannot be sold or transferred, and cannot be exchanged for money.
  • Points are linked to your account. If the account is closed, any unused balance is lost.
  • We may modify or terminate the programme at any time, giving reasonable prior notice on this page. Points already earned may be redeemed during the notice period.
  • We may cancel points obtained through error, fraud or abuse.

Gift cards. Gift cards issued by us may be used on this website until the expiry date shown on the card, which is never less than the minimum period required by Portuguese law. They cannot be exchanged for cash and are not reloadable. Loss or theft of a gift card should be reported to us immediately.

22. Liability

We are liable for damages arising from breach of our contractual obligations in accordance with applicable law.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under Decree-Law No. 383/89, for any harm caused by food that is unsafe or not in conformity, or for any other liability that cannot lawfully be excluded or limited. Nothing in these Terms affects the statutory rights of consumers.

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit or loss of data, nor for temporary unavailability of the site due to maintenance, technical failure or events beyond our reasonable control.

23. Third-party links

Our site may contain links to third-party websites. We do not control and are not responsible for their content, products or privacy practices.

24. Complaints book and dispute resolution

Electronic Complaints Book. Under Decree-Law No. 156/2005, you may submit a complaint through the official platform at www.livroreclamacoes.pt. The physical complaints book is also available in our store.

We have not adhered in advance to arbitration by that centre on a general basis. Nevertheless, under Article 14 of Law No. 144/2015, consumers may require arbitration before these centres for disputes up to €5,000, and in those cases the arbitration is binding on us.

25. Amendments

We may amend these Terms at any time. The version applicable to your order is the one in force when the order is placed. Changes are published on this page with an updated revision date.

26. Severability and entire agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, the Cookie Policy and the Order, Collection & Refund Policy, constitute the entire agreement between the parties in relation to their subject matter.

27. Governing law and jurisdiction

These Terms are governed by Portuguese law. Mandatory consumer protection provisions of the country of the consumer's habitual residence within the European Union continue to apply.
